This document contains the rules for using the Questionnaire at motorfinance.harcusparker.co.uk (the ‘Questionnaire’). By accessing and/or using any part of the Questionnaire you confirm that you accept these terms of use and that you agree to comply with them.
If you do not agree to these terms, you must not use the Questionnaire.
The Questionnaire and any documents available in it or otherwise associated with the contemplated claim are:
- confidential to Harcus Parker Limited (the ‘Solicitors’). They contain the Solicitors’ work product and know-how, and are commercially sensitive;
- privileged as between the Solicitors, their clients and potential clients; and
- only made available for the purposes of allowing potential clients of the Solicitors to evaluate whether or not they wish to join the claim, and if they do, to allow them to do so.
If you do not in good faith believe that you are eligible to join the Motor Finance Litigation, then you must not continue with the Questionnaire.
By accessing and/or using the Questionnaire, you agree and confirm that you:
- have not instructed another law firm, or acted as a litigant in person, to bring any claim similar to the claim contemplated;
- have not transferred any interest in or created any lien upon or set-off right in respect of the money you could recover from the university from this claim;
- have not previously received damages or compensation, in cash or kind, for a claim similar to the claim contemplated;
- have not previously introduced and lost any claim similar to the claim contemplated, either as a litigant in person or represented by a law firm;
- do not act as a solicitor or work for a firm of solicitors acting (or intending to act) for other claimants or defendants in any claim similar to the claim contemplated;
- do not act as a solicitor or work for a case management company acting (or intending to act) for other claimants or defendants in any claim similar to the claim contemplated;
- are not an employee or associate of any employee of any potential defendant and nor are you a member of the legal team of any actual or potential defendant, and you do not intend to pass on any information about the case or this sign-up process to them or any other person or entity with an interest adverse to the claim;
- agree to keep the Questionnaire, its content and any other document associated with the contemplated claim confidential, regardless of whether you become a client of the Solicitors;
- do not have any bankruptcy or insolvency proceedings directly impacting you and/or any settlement or damages you may be awarded; and
- have the full right, title and authority to bring a claim as part of the claim.
